1. INTRODUCTION

Welcome to Kwizzdom! These Terms of Service ("Terms") govern your use of the Kwizzdom mobile application and website (collectively, the "Service") operated by QuintiGr Games j.d.o.o. ("we," "us," or "our"), a company registered in Croatia.

By accessing or using Kwizzdom, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.

2. ELIGIBILITY

2.1 Age Requirement

You must be at least 18 years old to use Kwizzdom. By using the Service, you represent and warrant that you are at least 18 years of age. We reserve the right to request proof of age at any time.

2.2 Geographic Restrictions

The Service is available worldwide, but you are responsible for ensuring that your use of the Service complies with all local laws and regulations in your jurisdiction.

2.3 Account Suspension

We reserve the right to refuse service, terminate accounts, or remove or edit content at our sole discretion.

3. ACCOUNT REGISTRATION

3.1 Account Creation

To access certain features of Kwizzdom, you must create an account. You may register using:

• Email and password authentication
• Google OAuth

3.2 Account Information

You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security of your account credentials
• Immediately notify us of any unauthorized use of your account
• Accept responsibility for all activities that occur under your account

3.3 Account Ownership

You may not transfer, sell, or otherwise convey your account to any other person or entity. Accounts are personal to you and may not be shared.

3.4 Account Deletion

You may request deletion of your account by contacting us at kwizzdom.contact@gmail.com. We will process your request within 30 days. Please note that certain information may be retained as required by law or for legitimate business purposes, including financial transaction records which will be retained for 7 years in compliance with Croatian tax law.

4. THE KWIZZDOM SERVICE

4.1 Service Description

Kwizzdom is a skill-based quiz competition platform where users:

• Purchase tickets to enter quiz competitions
• Compete against other players in timed quiz challenges
• Earn cash prizes based on performance and ranking
• Withdraw winnings through Stripe Express Connect

4.2 Skill-Based Gaming

Kwizzdom is a game of skill, not chance. Success depends on:

• Knowledge and correct answers
• Speed of response
• Strategic decision-making

No element of chance determines the outcome of competitions.

5. TICKETS AND PAYMENTS

5.1 Ticket Purchase

Users purchase tickets in bundles to enter quiz competitions. Ticket bundles are available at various price points (e.g., 5 tickets for €5.30).

5.2 Ticket Pricing

• Purchase Price: The amount you pay includes payment processing fees (e.g., €5.30 for 5 tickets)
• Ticket Value: Tickets have a value of €1.00 per ticket for quiz entry purposes (e.g., 5 tickets = €5.00 value)
• The difference accounts for payment processing fees charged by our payment processor

5.3 Quiz Entry Requirements

Different quizzes require different numbers of tickets to enter (e.g., 1, 2, 5, or 10 tickets). The ticket requirement is clearly displayed before entry.

5.4 Payment Processing

All payments are processed securely through Stripe. We do not store your credit card information. By making a purchase, you agree to Stripe's terms and conditions.

5.5 No Refunds

5.6 Pricing Changes

We reserve the right to modify ticket pricing at any time. Price changes will not affect tickets already purchased.

6. QUIZ COMPETITIONS

6.1 Quiz Format

Quizzes operate as follows:

• Quizzes start at scheduled times (e.g., noon)
• Players can join within a 1-minute entry window
• Once started, players answer quiz questions within time limits (e.g., 8 seconds per question)
• Quizzes conclude approximately 4 minutes after start time
• Each player competes individually

6.2 Scoring System

Players are scored based on:

• Correctness: Number of correct answers
• Speed: Time taken to answer

Players are ranked by their combined score.

6.3 Quiz Questions

• All quiz questions are created and curated by Kwizzdom
• Questions undergo quality assurance before appearing in competitions
• Question content and answers are final and not subject to dispute

6.4 Technical Requirements

• Quizzes are only playable on mobile devices (smartphones)
• You must have a stable internet connection
• We are not responsible for technical issues on your device or internet connection

6.5 Fair Play

You agree to:

• Play quizzes individually without assistance
• Not use automated tools, bots, or scripts
• Not exploit bugs or technical issues
• Not collude with other players
• Not use multiple accounts

7. PRIZE POOLS AND WINNINGS

7.1 Prize Pool Calculation

The prize pool for each quiz is calculated as follows:

• Total Prize Pool = 85% of the total ticket value entered by all participants
• Platform Fee = 15% of the total ticket value (our business operating fee)

7.2 Prize Distribution

Prizes are distributed based on ranking and the specific distribution model for each quiz:

• Everyone Wins: All participants receive a portion (smaller individual prizes)
• Top 20%: Only the top 20% of players receive prizes
• Top 10%: Only the top 10% of players receive prizes
• Top 5%: Only the top 5% of players receive prizes

The distribution model is clearly displayed before quiz entry.

7.3 Winnings Representation

Winnings are represented in "points" where:

• 100 points = €1.00
• This conversion rate is fixed

7.4 Mandatory Donations

When redeeming winnings, you must allocate a minimum of 5% to charitable donations. You may choose to donate up to 100% of your winnings. The remaining amount (after donation) is available for withdrawal.

7.5 Charitable Donations

• Donation recipients are selected by Kwizzdom
• Donations are primarily directed to Croatian charitable organizations
• Donation totals and recipients are disclosed on our donations page
• Tax receipts for donations are not currently available but may be offered in the future

8. WITHDRAWALS

8.1 Withdrawal Requirements

To withdraw winnings, you must:

• Have a minimum balance of 1,000 points (€10.00)
• Complete Stripe Express Connect account setup
• Provide required identification and banking information to Stripe

8.2 Stripe Express Connect

• Withdrawals are processed through Stripe Express Connect
• You must be at least 18 years old to create a Stripe account
• You must comply with Stripe's terms and verification requirements
• We are not responsible for Stripe's verification process or delays

8.3 Processing Time

Withdrawals typically process within 2-3 business days after approval, subject to Stripe's processing schedule.

8.4 Withdrawal Fees

We do not charge withdrawal fees. However, Stripe may charge fees based on your banking institution and location.

8.5 Unclaimed Winnings

If you do not log in to your account for 1 year, any unclaimed winnings will be forfeited and absorbed by the platform. We will make reasonable efforts to notify you before forfeiture.

9. PROHIBITED CONDUCT

You agree not to:

9.1 Cheating and Fraud

• Use any cheating methods, exploits, or hacks
• Create multiple accounts to gain unfair advantages
• Collude with other players
• Manipulate quiz results or rankings
• Use automated tools, bots, or scripts

9.2 Abuse and Harassment

• Harass, threaten, or abuse other users or our staff
• Use offensive, inappropriate, or abusive usernames or profile content
• Engage in any form of discrimination

9.3 Illegal Activities

• Violate any applicable laws or regulations
• Engage in money laundering or fraud
• Use the Service for any illegal purpose

9.4 System Interference

• Interfere with or disrupt the Service or servers
• Attempt to gain unauthorized access to any part of the Service
• Reverse engineer, decompile, or disassemble any part of the Service

10. ACCOUNT SUSPENSION AND TERMINATION

10.1 Our Right to Terminate

We reserve the right to suspend or terminate your account immediately, without notice, for:

• Violation of these Terms
• Suspected cheating or fraudulent activity
• Abusive behavior
• Any conduct we deem harmful to the Service or other users

11. INTELLECTUAL PROPERTY

11.1 Our Content

All content on Kwizzdom, including but not limited to:

• Quiz questions and answers
• Software and code
• Graphics, logos, and design
• Text and documentation

is owned by QuintiGr Games j.d.o.o. or our licensors and is protected by copyright, trademark, and other intellectual property laws.

11.2 License to Use

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes, subject to these Terms.

11.3 Restrictions

You may not:

• Copy, modify, or create derivative works of the Service
• Distribute, sell, or transfer any part of the Service
• Use the Service for commercial purposes without our permission
• Remove or modify any copyright or proprietary notices

11.4 User Content

By uploading profile pictures or other content, you grant us a worldwide, non-exclusive, royalty-free license to use, display, and distribute such content in connection with the Service.

12. DISCLAIMERS

12.1 Service Provided "As Is"

12.2 No Guarantee of Availability

We do not guarantee that:

• The Service will be uninterrupted, timely, secure, or error-free
• The results obtained from using the Service will be accurate or reliable
• Any errors or defects will be corrected

12.3 Technical Issues

We are not responsible for:

• Loss of connectivity or internet access
• Device malfunctions or compatibility issues
• Data loss or corruption
• Third-party service failures (including Stripe, AWS, Google)

12.4 Financial Risks

You acknowledge that:

• Participation in quizzes involves financial risk
• You may lose the value of tickets purchased
• Winnings are not guaranteed
• You are responsible for any tax obligations related to winnings

13. LIMITATION OF LIABILITY

13.1 Maximum Liability

Some jurisdictions do not allow the exclusion of certain warranties or limitations on liability. In such jurisdictions, our liability will be limited to the greatest extent permitted by law.

14. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless QuintiGr Games j.d.o.o., its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of another party
• Your violation of any applicable laws or regulations

15. DISPUTE RESOLUTION

15.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Croatia, without regard to its conflict of law provisions.

15.2 Jurisdiction

Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of Brodsko-posavska županija, Croatia.

15.3 Mandatory Arbitration

Before filing any court action, you agree to attempt to resolve any dispute through good-faith negotiations. If negotiations fail, disputes will be resolved through binding arbitration in accordance with Croatian arbitration law.

15.4 Class Action Waiver

You agree to resolve disputes on an individual basis only. You waive any right to participate in class action lawsuits or class-wide arbitration.

16. GENERAL PROVISIONS

16.1 Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by:

• Posting the updated Terms on our website
• Sending email notifications (if applicable)
• In-app notifications

Your continued use of the Service after changes constitutes acceptance of the modified Terms.

16.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

16.3 Entire Agreement

These Terms constitute the entire agreement between you and QuintiGr Games j.d.o.o. regarding the Service and supersede all prior agreements and understandings.

16.4 No Waiver

Our failure to enforce any provision of these Terms shall not be deemed a waiver of that provision or any other provision.

16.5 Assignment

You may not assign or transfer your rights under these Terms. We may assign our rights and obligations without restriction.

16.6 Force Majeure

We shall not be liable for any failure to perform due to circumstances beyond our reasonable control, including acts of God, war, terrorism, pandemics, or government actions.

17. APPLE APP STORE TERMS

If you access the Service through the Apple App Store, you acknowledge and agree that:

• These Terms are between you and QuintiGr Games j.d.o.o., not Apple
• Apple has no obligation to provide maintenance or support for the Service
• Apple is not responsible for any product warranties
• Apple is not responsible for addressing any claims by you or third parties
• Apple is a third-party beneficiary of these Terms and may enforce them

18. GOOGLE PLAY STORE TERMS

If you access the Service through Google Play, you agree to the Google Play Terms of Service, and these Terms do not conflict with the Google Play Terms of Service.
